Terms of Service

Please read these terms carefully before using RushTech POS. By accessing or using our platform, you agree to be bound by these terms.

1 Acceptance of Terms

By creating an account, accessing, or using the RushTech POS platform ("Service"), you ("User", "you", "your") agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and any additional guidelines or rules referenced herein.

If you are using the Service on behalf of a business or organisation, you represent and warrant that you have the authority to bind that entity to these Terms, and the terms "you" and "your" refer to that entity.

Important: If you do not agree with any part of these Terms, you must not access or use the Service.

2 Description of Service

RushTech POS is a cloud-based point-of-sale platform designed for restaurants, takeaway shops, and retail stores. The Service includes, but is not limited to:

  • Point-of-sale order management and billing
  • Inventory and stock tracking
  • Kitchen Display System (KDS) for order preparation
  • Customer and loyalty programme management
  • Sales analytics, reports, and dashboards
  • Self-order kiosk and QR menu features
  • Multi-user access with role-based permissions
  • Invoice generation and printing capabilities

We reserve the right to modify, update, or discontinue any part of the Service at any time, with reasonable notice when possible.

3 Account Registration

To access the Service, you must create an account. When registering, you agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information to keep it accurate
  • Keep your login credentials confidential and not share them with unauthorised parties
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorised access or security breach

We reserve the right to suspend or terminate accounts that contain false or misleading information, or that are used in violation of these Terms.

4 Subscription Plans & Payments

Free Plan: RushTech POS offers a free-forever plan with limited features. No credit card is required for the free plan.

Paid Plans: Premium features are available through paid subscription plans. By subscribing to a paid plan:

  • You agree to pay the applicable fees as displayed at the time of purchase
  • Subscription fees are billed on a recurring basis (monthly or annually) depending on your chosen plan
  • All fees are quoted in Indian Rupees (INR) unless otherwise stated
  • Payments are processed securely through our authorised payment partners
  • You authorise us to charge your chosen payment method for recurring billing

Refunds: Subscription fees are generally non-refundable. However, if you experience a significant service issue, you may contact our support team to discuss your situation. Refund requests will be evaluated on a case-by-case basis.

Price Changes: We may update pricing from time to time. Existing subscribers will be given at least 30 days' notice before any price increase takes effect on their next billing cycle.

5 Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

  • Use the Service for any illegal, fraudulent, or unauthorised purpose
  • Attempt to gain unauthorised access to any part of the Service, other accounts, or related systems
  • Upload or transmit viruses, malware, or any harmful code
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Resell, sublicense, or redistribute the Service without our written consent
  • Use automated tools (bots, scrapers) to access the Service in a manner that degrades performance
  • Interfere with or disrupt the integrity or performance of the Service
  • Harass, abuse, or harm other users of the platform

Violation of these rules may result in immediate suspension or termination of your account without notice or refund.

6 Your Data & Content

Ownership: You retain full ownership of all data, content, and information you enter into the Service ("Your Data"). RushTech POS does not claim any ownership rights over Your Data.

License: By using the Service, you grant us a limited, non-exclusive license to access, process, and display Your Data solely for the purpose of providing and improving the Service.

Data Protection: We handle Your Data in accordance with our Privacy Policy. We implement industry-standard security measures to protect your information.

Data Export: You may export Your Data at any time through the features available in the platform. Upon account termination, we will provide a reasonable window for you to export Your Data before deletion.

Responsibility: You are solely responsible for the accuracy, legality, and appropriateness of Your Data. You must ensure your use of the Service complies with all applicable data protection laws.

7 Intellectual Property

The Service, including its design, code, features, logos, trademarks, and all related intellectual property, is owned by RushTech POS and is protected by applicable intellectual property laws.

  • You may not copy, modify, or create derivative works based on the Service without written permission
  • The RushTech POS name, logo, and branding are trademarks of RushTech POS and may not be used without authorisation
  • All feedback, suggestions, or ideas you submit regarding the Service may be used by us without obligation to you
  • Third-party trademarks, logos, and names referenced in the Service belong to their respective owners

8 Service Availability & Support

Uptime: We strive to maintain high availability of the Service. However, we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (with advance notice when possible)
  • Emergency maintenance to address critical issues
  • Factors beyond our reasonable control (force majeure, internet outages, etc.)

Support: We provide customer support via email and phone during business hours. Response times may vary based on your subscription plan and the nature of your enquiry.

Updates: We may release updates, patches, or new features from time to time. These updates may be applied automatically and are subject to these Terms.

9 Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied
  • We do not warrant that the Service will meet all your specific requirements or expectations
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
  • Our total aggregate liability for any claims related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim
  • We are not liable for any loss of data, revenue, profits, or business opportunities resulting from service interruptions or errors

Note: Some jurisdictions do not allow limitations on implied warranties or liability. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

10 Indemnification

You agree to indemnify, defend, and hold harmless RushTech POS, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from or related to:

  • Your use or misuse of the Service
  • Your violation of these Terms or any applicable law or regulation
  • Your violation of any third-party rights, including intellectual property rights
  • Any data or content you enter, upload, or transmit through the Service

11 Termination

By You: You may terminate your account at any time by contacting our support team or using the account closure option within the platform. Upon termination:

  • Your access to the Service will cease immediately
  • You will have a 30-day grace period to export Your Data
  • No refund will be issued for the remaining period of a paid subscription

By Us: We may suspend or terminate your account at any time if:

  • You breach any provision of these Terms
  • Your account poses a security risk to the Service or other users
  • Your account has been inactive for an extended period (12 months or more)
  • Continued provision of the Service becomes commercially impractical

We will make reasonable efforts to notify you before termination, except in cases of severe policy violations or security threats.

12 Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

  • Any disputes arising from these Terms or the Service shall first be addressed through good-faith negotiation
  • If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996
  • The seat of arbitration shall be Gujarat, India
  • The language of arbitration shall be English
  • The courts of Gujarat, India shall have exclusive jurisdiction for any matters not subject to arbitration

13 Changes to These Terms

We reserve the right to modify these Terms at any time. When significant changes are made:

  • We will update the "Effective Date" at the top of this page
  • We will notify you via email or through an in-app notification at least 15 days before the changes take effect
  • Continued use of the Service after changes take effect constitutes acceptance of the updated Terms
  • If you do not agree to the updated Terms, you must stop using the Service and close your account
